(Chapter 106)

TELECOMMUNICATION (EXEMPTION FROM LICENSING) ORDER 1979

Made by the Governor in Council under section 39

1. This order may be cited as the Telecommunication (Exemption Cuatının. from Licensing! Order 1979.

2. In this order, unless the context otherwise requires—

"company" means the Hong Kong Telephone Company Limited.

Interpretation.

The following persons are exempted, to the extent specified. from Exemptor, the obligation to hold a licence under section 8(1)(a) of the Telecom- (035, 106 + munication Ordinanc÷—

the company, subject to the conditions specified in paragraph 4. to the extent that it establishes or maintains a means of telecom- munication by the use of any part of the public telephone system maintained and operated under the Telephone Ordinance—

(i) for any non-telephonic service other than that covered by an exclusive licence issued under sections 7 and 34 of the Tele- communication Ordinance: and

(ii) for the provision of circuits for services provided under an exclusive licence or other licence issued or deemed to be issued under the Telecommunication Ordinance; and

(b) any person to the extent that he possesses or uses apparatus connected to the public telephone system for the use of any service referred to in sub-paragraph (@Xi).

4. The company shall-

(a) establish and maintain the services and circuits referred to in

paragraph 3(a) to the satisfaction of the Authority; and

(b) not directly or indirectly fix, levy-or-make payable any charge. for any such service or circuit greater than the appropriate charge in accordance with such scale of charges as may, from time to time. be specified by the Authority by order published in the Gazette.

Explanatory Note

This order exempts the Heng Kong Telephone Company Limited from the requirement to obtain a licence under section 8(1)(u) of the Telecommunication. Ordinance in respect of certain telecommunications services established or maintained by the Company and using the public telephone system. The order also exempts from the licensing require- ment any person whi uses apparatus that is connected to the public telephone system for the use of anv of such telecommunications services operate: or maintained by the Company
