on a third or subsequent conviction to a fine of
$100,000.

It shall be a defence to a charge under
subsection (2) that the person charged took all reasonable
precautions during the exhibition of the film to which the
charge relates to prevent the exhibition of the film to
persons under the age of 18 years.

A person who contravenes a condition endorsed on
(a)
a certificate of exemption issued under
section 9;
(b)
a certificate of approval is sued under section 13;
(c)
a certificate of exemption is sued under section
17; or
(d) a certificate of approval issued under section 18,

commits an offence and is liable on conviction to a fine of
$10,000 and imprisonment for 6 months.
