STATUS OF HONG KONG UNDER UK/CANADA FILMS CO-PRODUCTION AGREEMENT

The competent authorities in Canada responsible for administering the UK/Canada Films Co-production Agreement have received an equiry from a Canadian producer who is interested in making a Co-production film with a Hong Kong producer. I would be grateful for your advice as to whether a production involving a Hong Kong producer could qualify under the UK/Canada Coproduction Agreement (copy attached for ease of reference).

2. Clause 2a) of Article 1 sets out the definition of UK nationals for the purposes of the Agreement and I would welcome your views on whether Hong Kong would be eligible for status as a colony of the United Kingdom in this context.

I would also welcome your advice on the possible implications for Hong Kong's future status as a result of the Sino/UK Agreement which assigns to China certain rights of sovereignty over Hong Kong. I realise that you may wish to consult the Solicitors Division in FCO on this point.
