CONTROL OF OBSCENE AND INDECENT ARTICLES REGULATIONS 1987
The Problem
Following the introduction
of the Control of
Obscene and Indecent Articles Ordinance, Regulations under that Ordinance must now be made.

Recommendation and Advice Sought

It is recommended that under section 46 of the Control of Obscene and Indecent Articles Ordinance (Ordinance 9/87) the Control of Obscene and Indecent Articles Regulations 1987, as set out at Annex A, should be made.

Members will be asked to advise whether this recommendation should be approved.
Background and Argument

The Control of Obscene and Indecent Articles Bill 1986 was passed by the Legislative Council on 18 February 1987 and received the assent of the Acting Governor on 19 February 1987. A copy of the new Ordinance is at Annex B.

Section 46 of the Ordinance empowers the Governor
in Council to make regulations to provide for
-
(a)
fees;
(b)
the manner of giving notice under section 18;
(c)
the empowering of a Tribunal or the Registrar to waive any prescribed fee; and
(d)
the
payment
of fees and allowances
to
adjudicators.
