Amend the Control of Publications Consolidation Ordinance.

Enacted by the Governor of Hong Kong, with the advice and consent of the Legislative Council thereof.

1. This Ordinance may be cited as the Control of Publications Consolidation Short title. (Amendment) Ordinance 1987.

2. The long title to the principal Ordinance is repealed and replaced by the Repeal and following-

replacement of long title. (Cap. 268.)

"To provide for the registration of local newspapers and news agencies and the

licensing of newspaper distributors and for matters connected therewith.".

Section 1 of the principal Ordinance is amended by deleting "Control of Amendment of Publications Consolidation" and substituting the following—

"Registration of Local Newspapers".

Section 2 of the principal Ordinance is amended-

(a) in the definition of "address" by deleting "the Colony" and substituting the

following-

“Hong Kong”;

(b) by deleting the definition of "import";

(c) by deleting the definition of "local newspaper" and substituting the

following—

""local newspaper" means a newspaper printed or produced in Hong

Kong;":

(d) in the definition of "newspaper" by inserting after "thereto" the following- "but excludes any publication which is not available to the public at large or which comprises exclusively any item or items specified in the Schedule"; and

(e) by deleting the definitions of "pamphlet", "periodical publication", "person", "printed document", "printing press" and "publication" and substituting the following-

""printed document" includes every piece of paper, cloth or other similar material, bearing any words, pictures or signs which were or appear to have been wholly or partly produced by any mechan- ical, electrical or other copying process in Hong Kong and the collection of such pieces of paper, cloth or other material in any bound or other permanent form;".

Sections 3, 4, 5 and 6 of the principal Ordinance are repealed.

Section 7 of the principal Ordinance is repealed and replaced by the Repeal and

7. (1) Every local newspaper shall be registered in accordance with regulations made under section 18.

(2) The proprietor of any local newspaper may at any time give notice to the Registrar that he desires the registration of that local newspaper to cease and the Registrar shall, on the receipt of such notice, cancel the registration of that local newspaper which shall cease to be registered from the date of such cancellation.".
