2C. (1) Subject to subsection (2), this Ordinance applies to every officer who is appointed or re-appointed to service under the Government before the date of commence- ment of the Pension Benefits Ordinance 1987, whether on transfer from other public service or otherwise, on terms which attract pension, gratuity or other allowance.
(2) This Ordinance shall not apply to a serving officer within the meaning of the Pension Benefits Ordinance 1987 to whom that Ordinance applies by virtue of section 4(1)(b) or (c) of that Ordinance.”
(e) in section 3(1)-
(i) by deleting "may be" and substituting the following-
"shall be";
(ii) by deleting "of the Colony" and substituting the follow- ing-
"under the Government"; and
(iii) by deleting "with the sanction of the Secretary of State"; (ƒ) in section 4 by deleting "revenues of the Colony" and substituting
the following—--
"revenue";
(g) by substituting the following for section 5—
"Pensions, etc. to be of right.
5. Except as otherwise provided in this Ordinance, the entitlement to pension, gratuity or other allowance under this Ordinance shall be a right.";
(h) in section 6—
(i) by deleting "Unless” and substituting the following-
"(1) Subject to subsection (2), unless";
(ii) by deleting "a pensionable" and substituting the follow- ing-
"an established";
(iii) in paragraph (a)(ii), by deleting "Secretary of State" and substituting the following-
"Governor";
(iv) in paragraph (aa), by deleting "and, if such officer was appointed with the approval of the Secretary of State and has not attained the normal age of retirement, when such retirement is with the approval of the Governor and Secretary of State";
