PENSION BENEFITS
(b) in the case of a person who held a non-establish
office, his salary as defined in regulation 25 of Pensions Regulations, if the regulations apply to him, or his pensionable emoluments as defined in section 2 of the Pension Benefits Ordinance 1987, if the Ordinance applies to him;
"Scheduled officer" has the same meaning assigned to it by section 2 of the Pension Benefits Ordinance 1987.";
(b) in section 3(1)—

(i) by deleting paragraph (a) and substituting the following--
“(a) under the Pensions Ordinance, the Police Force Ordin- ance 1932 or the Police Officers (Special Cases) Pen- sions Ordinance 1954 to a person who is aged not less than 55;
(aa) under the Pension Benefits Ordinance 1987 to a person-
(i) who was a serving officer within the meaning of that Ordinance and who is aged not less than 55;
(ii) who was appointed or re-appointed to service under the Government on or after 1 July 1987, other than a Scheduled officer, and who is aged not less than 60;
(iii) who was a Scheduled officer who was appointed or re-appointed to service under the Government on or after 1 July 1987 and who is aged not less than 60 or who has attained the retirement age which applies to him prescribed in an order under section 10(3) of that Ordin- ance, whichever is the lesser; or
(iv) who is granted a deferred pension under that Ordinance;"; and
(ii) in paragraph (b) —
(A) by deleting "6(e)" and substituting the following-
"6(1)(e)"; and
(B) by inserting after "Regulations" the following-
", or under section 11(1)(h) of the Pension Benefits Ordinance 1987”;
(c) in section 3(2), by deleting "in Hong Kong" in both places where it
occurs and substituting in each case the following-
(d) as regards section 4

"under the Government";
(i) by renumbering the section as subsection (1);
(ii) by deleting "may" and substituting the following—
"shall"; and
(iii) by inserting the following subsections after subsection (1)---
"(2) Subsection (1) shall apply to a basic pension which is a deferred pension under the Pension Benefits Ordinance 1987 with effect from the date the deferred pension is granted and shall apply to the commuted pension gratuity of a deferred
