PENSION BENEFITS

(n) in section 14—

(i) by substituting the following for subsection (1)—

"(1) Where a contributor ceases to be a public officer in such circumstances, other than his death, that—

(a) he is not eligible for the grant of a pension or an annual allowance under the Pensions Ordinance or a pension under the Pension Benefits Ordinance 1987; and

(b) he would not have become eligible for a pension or an annual allowance had he left the service in the circumstances described in paragraph (b) or (c) of section 6,

the whole of his contributions shall be returned to him."

(ii) in subsection (2)—

(A) by deleting "Where a contributor ceases to be a public officer in circumstances in which he is only eligible for a gratuity under regulation 5 of the Pensions Regulations, or in which he is eligible for a pension under the Pensions Ordinance (other than a pension under regulation 31 of the Pensions Regulations), or where a contributor trans- fers to other public service, then-" and substituting the following-

"Where a contributor ceases to be a public officer in circumstances---

(i) in which he is only eligible for a gratuity under regulation 5 of the Pensions Regula- tions or a short service gratuity under section 32 of the Pension Benefits Ordin- ance 1987; or

(ii) in which he is eligible for a pension or an annual allowance under the Pensions Ordinance (other than an additional pen- sion under regulation 31(1)(ii) or (iii) of the Pensions Regulations) or a pension under the Pension Benefits Ordinance 1987 (other than an additional pension under section 15(1) of that Ordinance); or (iii) where a contributor transfers to other

public service,

then-"; and

(B) in paragraph (d), by inserting after "Regulations" the

following-

"or a short service gratuity under section 32 of the Pension Benefits Ordinance 1987"; and

(iii) in subsection (3)(c), by deleting "to him" and substituting the following-

"to his personal representative";
