THE PENSION BENEFITS ORDINANCE 198Z

This Ordinance provides a new scheme of pension benefits, which subject to the Ordinance's provisions are to be as of right, for or in relation to officers appointed to service under the Government (of Hong Kong) on or after 1 July 1987.
2. Officers who are eligible for a pension or annual allowance under the Pensions Ordinance (Cap. 89) may, under section 8(1) of the Ordinance, opt into the scheme mentioned in paragraph 1.

In the Ordinance
section 32 provides for the payment of short service gratuities to officers whose service under the Government is insufficient to qualify them for pension benefits under the new scheme;
section 33 provides for exceptions and also for the Ordinance's provisions to be applied subject to modifications in specified circumstances; and
sections 36 to 55 provide for consequential amendments to harmonise with the Ordinance legislation previously in force and which continues in force.
Before the Governor assented to the Bill in the name and on behalf of Her Majesty, the Attorney General advised that he could properly do so.
