Line 3? After "Ordinance" add Cap 89. Can Legislation refer to Circulars?

We could not understand why a transfer to the new scheme be rejected.

After 'Governor' add "with the approval of the Secretary of State". Do we want to add references to Secretary of State approval for early retirements of serving HMOCS officers in 10(2) and for 10(3) (b) and proviso for senior ranks? Also do we want control by Secretary of State in 10(4)?

May have to be tightened up depending on changes to Clause 10.

Before 'upon' in line 2, add (i) then add (ii) "he retires in any other circumstances in which he

is permitted by the law or regulations of the service to retire on pension or gratuity.

fl

Provided that sub-paragraph (ii) of this paragraph shall not apply in the case of a female officer who retires for reason that she has or is about to be married.

We think this should be included to cover early retirement on eg redundancy or medical grounds.

Why limit this to over 10 years service?

Because of Colonial Regulations (para 68) add after "Government", "after consultation with the Secretary of State in the case of a member of HMOCS".

After "Governor" add "or the Secretary of State" [in the case of a member of HMOCs)]. Colonial Regulations stipulate that Secretary of State must approve such retirements.

Why "and has received" in line 3. Would award be given under the Ordinance if not received if this would be better?

Surely the relevant Ordinances should be amended to refer to Sections 14, 15 and 19 and deleted from here.

Proviso to (i). Could lead to special pleading.

Proviso at top of page. A generous gesture.

Pension does not usually re-start.
