NEW PENSIONS SCHEME
1. Thank you for your letter of 9 February. Apologies for the delay in reply (partly explained by the size and complexity of the Bill and Regulations, and partly by FCO telno 452).
2. I have now received Roy Foster (GAD)'s comments, and those of Chris Johnson (Janet Newby's successor) and her colleagues in ODA's Pensions Department (the latter has added some further thoughts on GAD's comments). I am afraid that in the time available (as today's FCO telegram explains) we have not been able to examine their points in any detail or to consult our Legal Advisers. But no doubt you and your own Legal Advisers will want to reach your own views on the various technical points that have been made.

3. I therefore offer only one marginal comment myself. Johnson has suggested that the new Pensions Bill may not be the right place for your Limited Corporation provisions. I have mentioned to her that our various exchanges on this last year resting with FCO telno 480 concluded that the LCS could be introduced by local legislation; that no UK legislation (eg by Order in Council) was needed; and that therefore we and our Legal Advisers had effectively left it to you and yours to decide where in your legislation these measures should be included. So far as I am concerned, and to subject to any further views our Legal Advisers may have next week, that remains the position.
