EXPLANATORY NOTE

Section 64 (1) of the Civil Aviation Act 1982 provides that no aircraft shall be used for the carriage for reward of passengers or cargo on a flight to which the subsection applies unless the operator of the aircraft holds and complies with the terms of an air transport licence granted to him by the Civil Aviation Authority. Section 64 (2) sets out the flights to which section 64(1) applies. This Order amends section 64 (2) of the Act by excluding Hong Kong from the category of relevant overseas territories for the purposes of that subsection. Consequently, the provisions of section 64(1) shall not apply to any flight beginning or ending in the United Kingdom by an aircraft registered in Hong Kong.
