There is also potential difficulty over the

definition of 'nationals.

After 1997, while Britain will

regard BNO passport holders as British nationals, China may

regard them as Chinese nationals.

Most difficulties could probably be resolved by

administrative working arrangements between Hong Kong and UK

and which could be mirrored with China after 1997.

Course of Action

It is realised that it is likely to be difficult

to change the entire Convention to suit the Hong Kong

context. Nonetheless, it may be possible to work out means through which Hong Kong's unique position could be reflected in the Convention. It is suggested that a proposal should

be put forward at the ad hoc session of the IMO requesting

that a statement might be included in the preamble on the

following lines

"'it...ie-recognised that for some states, the..

enforcement of the Convention will fall upon

more than one shipping^administration"

This appears to have been the case in the drafting of the Drug Trafficking Convention, details of which are to be

looked into by Security Branch.
