Item (a)
(Navigational Warnings) Regs.
In the schedule item (10) in paragraph B has been omitted since it repeats item (2).
Item (b)
(Carriage of Nautical Publications) Regs.
Our Regulation 2 in our regulations includes definitions of
(i)
Notice to Mariners;
(ii)
Radio Navigational Warnings; and
(iii)
Recognised Hydrographer.
In Regulation 3 (a) the non-application is to vessels not exceeding 13.7 metres in length as opposed to 12 metres in the United Kingdom regulations. The length of 13.7 metres has been selected because it coincides with the length applicable to the higher qualifications required for masters of the larger pleasure vessels. In Regulation 4 reference is made to a "recognised hydrographer" rather than the "Hydrographer of the Navy". The idea is to allow greater flexibility of choice if other hydrographers are recognised and included in the second schedule.
The names of the publishers of the publications listed in the first schedule have not been included. Here again it is designed to allow greater flexibility.
Regulation 6 (b) differs from the United Kingdom. regulations by excluding vessels (except passenger ships) trading within river trade limits from the requirements to carry the publications listed in the first schedule.
Item (e)
(Pilot Ladders and Hoists) Regs.
Our Regulation 5 (2) omits reference to Ships of Class III to VI (A) inclusive since such ships do not operate in Hong Kong waters.
Whilst the regulations are now essentially in their final form (but subject to possible minor drafting changes) it is likely that we will insert an additional clause in those regulations which have schedules. This clause would delegate to the Director of Marine the power to amend the schedules. Action on this depends on the passage of the Merchant Shipping (Safety) (Amendment) Bill through ExCo and LegCo.
