An Ordinance to amend the Immigration Ordinance.

[1 July 1987]

Short title and

commencement.

Enacted by the Governor of Hong Kong, with the advice and consent of the Legislative Council thereof.

1. This Ordinance may be cited as the Immigration (Amendment) (No. 2) Ordinance 1987 and shall come into operation on 1 July 1987.

Amendment of section 2.

(Cap. 115.)

2. Section 2(1) of the principal Ordinance is amended—

(a) by deleting the definition of “the 1981 Act”";

(b) by deleting the definition of “British subject by naturalization in

Hong Kong”;

(c) by deleting the definition of “Chinese resident";

(d) by deleting the definition of “Commissioner of Registration" and

substituting the following-

(Cap. 177.)

"Commissioner of Registration" has the same meaning as it

has in the Registration of Persons Ordinance;";

(e) by deleting the definition of “by descent";

(f) by deleting the definition of "the former nationality Acts”;

(g) by deleting the definition of "Hong Kong belonger" and substitut-

ing the following—

""Hong Kong permanent resident" means a person who belongs to a class or description of persons specified in the First Schedule;";

(h) by deleting the definition of "identity card” and substituting the

following-

(Cap. 177.)

""identity card" has the same meaning as it has in the

Registration of Persons Ordinance;”;

(i) in the definition of "immigrant" by deleting "belonger" and

substituting the following—

"permanent resident";

(j) by deleting the definition of “naturalization in Hong Kong";

(k) by deleting the definition of "registration in Hong Kong";

(1) by inserting before the definition of "removal order" the

following-

""registration officer" has the same meaning as it has in the

Registration of Persons Ordinance;

"Registration of Persons Tribunal” means the Registration of Persons Tribunal established by section 3C of the Regis- tration of Persons Ordinance;";

(m) by deleting the definition of "resident British citizen" and

substituting the following-

""resident British citizen" means a British citizen who has at any time been ordinarily resident in Hong Kong for a continuous period of not less than 7 years either as a British citizen or partly as a United Kingdom belonger and partly as a British citizen;";

(n) in the definition of "resident United Kingdom belonger" by

deleting "has at any time been” and substituting the following—

"was at any time before 1 January 1983";

(0) by inserting after the definition of "resident United Kingdom

belonger" the following—

""right of abode in Hong Kong” means the right of abode in

Hong Kong referred to in Part IA;";

(p) by deleting the definition of "settled"; and

(q) in the definition of "United Kingdom belonger" by deleting “and

the wife and" and substituting the following--

"or was the wife or".

The principal Ordinance is amended by adding after Part I the Addition of

following
