ROAD TRAFFIC (AMENDMENT) BILL 1987

Explanatory Memorandum

This Bill amends the Road Traffic Ordinance to make provision for its application to light rail vehicles of the North-west Railway. For this purpose the definitions of “vehicle”, “driver” and “road” are amended by clause 2. A definition of “vehicle of the North-west Railway" is also added by clause 2.

2. Clause 3(a) extends to the North-west Railway the application of certain sections of the principal Ordinance which deal with the duty to stop in case of accidents, the preservation of evidence in case of serious accidents, and the obligation to give information to the police when traffic accidents or offences occur. Clause 3(6) extends the regulation-making powers in the Ordinance so that regulations may be expressed to apply in relation to the carriageway of the North-west Railway.

3. Clause 4 deletes section 4B of the principal Ordinance which duplicates the effect of section 4(1) as amended by clause 3(a).

4. Clause 5 adds a new provision empowering the Commissioner to exempt the vehicles of the North-west Railway from a general speed limit and impose a different speed limit therefor in respect of portions of roads and to erect signs for that purpose.

5. Clause 6 adds a new provision requiring a driver of a vehicle of the North-west Railway to obey directions given by a police officer in uniform in the event of an emergency.

草案第3(a)條把原有條例的若干條款的適用範圍擴大,以便該等條款亦 適用於新界西北部輕便鐵路;前述有關條文對發生交通意外時停車的責任、保存嚴 重交通意外的證據,以及在交通意外或違例事情發生時,向警務人員提供資料的責 任等事宜,都有所規定。草案第3(b)條擴大道路交通條例內載的制定規例權力,以 便有關規例可以明確規定得適用於與新界西北部輕便鐵路行車道有關事宜。

草案第4條刪除原有條例第4條,因其作用與經本草案第3(a)條修訂 後的原有條例第4(1)條相同。
