An Ordinance to amend the Protection of Wages on Insolvency Ordinance.

[3 July 1987]

Enacted by the Governor of Hong Kong, with the advice and consent of the Legislative Council thereof.

1. This Ordinance may be cited as the Protection of Wages on Short title. Insolvency (Amendment) Ordinance 1987.

Section 2 of the principal Ordinance is amended-

Amendment of section 2.

(a) in the definition of "applicant" by deleting “(b) or (c)” wherever it (Cap. 380.)

occurs and substituting the following—

“(b), (c) or (cc)"; and

(b) by inserting after the definition of "wages" the following

definition-

(Cap. 32.)

"wages in lieu of notice" means wages in lieu of notice in respect of which an applicant would, on the winding up of a company, be entitled to priority under section 265(1)(cc) of the Companies Ordinance, or would, in a bankruptcy, be entitled to priority under section 38(1)(cc) of the Bankruptcy Ordinance;".

Section 15 of the principal Ordinance is amended-

(a) in subsection (1) by inserting after "wages" wherever it occurs the

following-

"or wages in lieu of notice or both";
