An Ordinance to amend the Road Traffic Ordinance.

[3 July 1987]

Enacted by the Governor of Hong Kong, with the advice and consent of the Legislative Council thereof.

1. This Ordinance may be cited as the Road Traffic (Amendment) Ordinance 1987.

Amendment of section 2.

Section 2 of the principal Ordinance is amended-

(Cap. 374.)

(a) in the definition of "driver", by inserting before "or tram" the

following

", vehicle of the North-west Railway,”;

(b) in the definition of “road”-

(i) by inserting after "Crown," the following

"and includes the carriageway of the North-west Railway,”; and

(ii) by deleting "to any carriageway" and substituting the following-

“any part of the carriageway";

(c) in the definition of "vehicle", by inserting before "a tram" the

following-

"a vehicle of the North-west Railway or"; and

(d) by inserting after the definition of "vehicle licence" the following- ""vehicle of the North-west Railway" means a light rail vehicle including a vehicle used for maintenance pur- poses operated along and by means of the rails of the North-west Railway;”.

3. Section 4 of the principal Ordinance is amended—

(a) in subsection (1), by inserting after "North-west Railway" the

following-

"and sections 56, 57, 63 and 64 shall apply to vehicles of the North-west Railway on any part of the carriageway of the North-west Railway that is not a road in the same way as those sections apply in relation to vehicles on roads";

(b) in subsection (2), by inserting after "North-west Railway" the

following ----

"and may also be expressed to apply in relation to any part of the carriageway of the North-west Railway specified in the regulations,".

Section 4B of the principal Ordinance is repealed.

Section 40 of the principal Ordinance is amended-

(a) in subsection (2)—

(i) by deleting the full stop at the end of paragraph (b) and substituting a semicolon; and

(ii) by inserting after paragraph (b) the following—

"(c) in respect of any portion of a road, exempt vehicles of the North-west Railway from the speed limit prescribed under subsection (1) and prescribe a different speed limit at which a vehicle of the North-west Railway may be driven on that portion of the road and different limits may be prescribed in respect of different portions of a road.";

(b) by inserting after subsection (5) the following-

"(6) Where the Commissioner prescribes a different speed limit for vehicles of the North-west Railway in respect of a portion of road under subsection (2)(c), the Commis- sioner may cause traffic signs to be so erected, replaced, removed or altered as to give adequate guidance or notice to drivers of vehicles of the North-west Railway of the applica- tion of that speed limit to that portion of road.”.

Amendment of section 40.

6. The principal Ordinance is amended by adding after section 61 the Addition of following---

"Drivers of vehicles of the North-west Railway to obey police directions in

emergency.

61A. (1) Where there is an emergency on or in the vicinity of the carriageway of the North-west Railway, a police officer in uniform may give directions to the driver of any vehicle of the North-west Railway for the purpose of saving or protecting any life or property in imminent danger or clearing any obstruction to the North-west Railway and any such driver shall obey the directions.

(2) Any driver of a vehicle of the North-west Railway who fails to obey a direction of a police officer given under subsection (1) commits an offence and is liable to a fine of $2,000.".
