IMMIGRATION (AMENDMENT) (NO. 2)

12. Section 13 of the principal Ordinance is amended—

(a) by deleting “such person” in the first place where it occurs and

substituting the following---

"he"; and

(b) by deleting "in the case of any such person" and substituting the

following--

"to him".

13. Section 13A(1)(b) of the principal Ordinance is amended by deleting "(c)" and substituting the following--

"(b)".

14. Section 17B(1)(a) of the principal Ordinance is amended by inserting after "his" the following—

"valid".

15. Section 17C(4)(a) of the principal Ordinance is amended by deleting "the Commissioner of Registration or to any assistant commis- sioner, district registrar or registrar, of registration" and substituting the following-

"a registration officer".

16. Section 19 of the principal Ordinance is amended— (a) in subsection (1)(b)——

(i) by deleting “subject to subsection (2),”; and

(ii) in sub-paragraph (iia), by inserting before "has" the following-

"not being a person who enjoys the right of abode in Hong Kong, or has the right to land in Hong Kong by virtue of section 8(1),";

(b) by deleting subsection (2); and

(c) in subsection (3), by deleting "a person who immediately before

1 January 1983 was".

17. Section 20 of the principal Ordinance is amended-

(a) in subsection (1), by deleting "Chinese resident, a British citizen or a resident British citizen or a person who immediately before 1 January 1983 was a United Kingdom belonger or a resident" and substituting the following-

"British citizen or a";

(b) in subsection (2), by deleting "a Chinese resident, a British citizen, other than a resident British citizen, or a person who immediately before 1 January 1983 was a United Kingdom belonger," and substituting the following-

"a British citizen other than a resident British citizen, or a United Kingdom belonger"; and

(c) in subsection (3), by deleting "Chinese resident, a British citizen or a person who immediately before 1 January 1983 was" and substituting the following--

"British citizen or";

(d) in subsection (4), by deleting "a person who immediately before

1 January 1983 was"; and

(e) by deleting subsection (6).

18. Section 21(1) of the principal Ordinance is amended- (a) by deleting "an adult Chinese resident,"; and

(b) by deleting "or a person who immediately before 1 January 1983 was an adult United Kingdom belonger" and substituting the following

"other than a resident British citizen, or an adult United Kingdom belonger other than a resident United Kingdom belonger,".

19. Section 22(1) of the principal Ordinance is amended-

(a) in paragraph (a), by deleting "a person who immediately before

1 January 1983 was"; and

(b) by deleting paragraph (b) and substituting the following-

"(b) a deportation order should be made against a British

citizen or a United Kingdom belonger,”.

Amendment of section 21.

Amendment of section 22.

20. Section 37B(1) of the principal Ordinance is amended by inserting Amendment of after "who" the following-

"enjoy the right of abode in Hong Kong, or".

21. Section 53 of the principal Ordinance is amended--

(a) in subsection (7), by deleting "any" and substituting the

following-

"the right of abode in Hong Kong or";

(b) by deleting subsection (8) and substituting the following--

"(8) No objection shall be made under this section-

(a) to a warrant of detention issued under section

13A(6); or

(b) to a removal order made by the Director of Immigration or the Deputy Director of Immigra- tion; or

(c) to the decision of an adjudicator; or

(d) to the decision of a public officer in respect of the right of abode in Hong Kong of any person where the Registration of Persons Tribunal has previously determined that that person does not enjoy that right.".

22. Section 53A of the principal Ordinance is amended-

(a) in subsection (1), by inserting before paragraph (a) the following

"(aa) he enjoys the right of abode in Hong Kong; or"; and (b) by inserting after subsection (2) the following-

"(3) Where the Tribunal, upon an examination of—

section 37B.

Amendment of section 53A.
