It has further been agreed between the two Governments that to ensure a smooth transition, the new forms of Hong Kong identity cards (i.e. a permanent identity card which states that its holder has the right of abode in Hong Kong for

To implement these

agreements, it is necessary to amend the Hong Kong legislation to introduce the term "right of abode in Hong Kong" and to provide for the issue of new forms of identity card.

Legislative proposals in support of the right of abode endorsement involve amending Immigration Ordinance (Chapter 115) and Registration of Persons Ordinance and its Regulations (Chapter 177).

Existing provisions relating to "right of abode"

At present the Immigration Ordinance does not contain the term

term "right of abode". It confers the "right to land" in Hong

Hong Kong, a right which includes the right to enter and to remain free of conditions of stay, on -

(a)

"Hong Kong belongers" (broadly speaking persons who are British Dependent Territories citizens (BDTCs) by virtue of a connection with Hong Kong). There at present about 3.25 million BDTCs in

Hong Kong including an estimated 11,500 non-ethnic Chinese BDTCs;

"Chinese residents" (persons wholly or partly of Chinese race who have at any time been ordinarily resident in Hong Kong for a continuous period of not less than 7 years), of whom
