On 24 XCR (87) 35, the Council advised and the Acting Governor ordered, inter alia, that the LRTC should at the appropriate time be required publicly to justify the proposal that it should be exempted under Clause 38 of the draft Noise Control Bill.

The Light Rail Transit (LRT) is also covered by the provisions of the Kowloon-Canton Railway Corporation Ordinance (Chapter 372) as a result of the Kowloon-Canton Railway Corporation (Amendment) Ordinance 1986. There is no need for separate legislation. Clause 38 would apply in future to the LRT as well as the Kowloon-Canton Railway (KCR) and the Mass Transit Railway (MTR).

In view of Members' concern about the special consideration given
the Mass
Mass Transit Railway Corporation (MTRC), the Kowloon-Canton Railway Corporation (KCRC) and the LRT, this memorandum sets out for Members' information the relevant provisions for the railways in the draft Noise Control Bill.
Construction noise

At present, the controls on construction noise between 7 p.m. and 7 a.m. and on Sundays and general holidays do not apply to construction activities in connection with the railways. The existing MTRC and KCRC Ordinances both contain provisions which provide exemptions for the MTR, KCR and LRT from the construction noise provisions of the Summary Offences Ordinance. The draft Noise Control Bill removes these exemptions and requires the MTR, KCR and LRT to comply

Non-construction noise

The draft Bill introduces new provisions (Clause 12) in relation to all forms of noise generated by non-construction activities within
activities within industrial and commercial premises which, inter-alia, include those of the MTR, KCR and LRT. These premises include maintenance depots, commercial developments, etc., as well as the reserves on which the trains actually run.
