Introduction

The purpose of this memorandum is to seek Members' advice on whether the Air Pollution Control (Amendment) Bill 1987 (referred to hereafter as the draft Bill) at Annex A should be introduced into the Legislative Council, and whether the Air Pollution Control (Specified Processes) Regulations 1987 (referred to hereafter as the draft Regulations) at Annex B should be approved in principle to be referred back to Members after the Bill has passed into law.

ΤΟ improve air quality standards which had deteriorated over the previous decade, the Air Pollution Control Ordinance (Chapter 311) (referred to hereafter as the Ordinance) was enacted in 1983. replaced the Clean Air Ordinance then in force and provided safeguards against both concentrated discharges and the long-term effects of exposure to lower levels of air pollutants. The Ordinance enables the introduction of measures to control all air pollutants emitted from stationary sources, including a wide range of toxic emissions.

Besides making provision for the abatement nuisances caused by air pollution and the banning of unsuitable fuels and materials, the Ordinance also provides for the control of

of 23 classes of industry, known as "specified processes" (Section 2 and First Schedule). Section 43 empowers the making of regulations to control these specified processes. The relevant provisions-can be summarized as follows:
