37. Nothing in this Ordinance shall apply to noise

within the meaning of the Civil Aviation (Aircraft Noise)

Ordinance 1986.

Application of section 12 to Mass Transit Railway Corporation and Kowloon- Canton Railway Corporation.

Application to Crown.

38. Section 12 shall apply to the Mass Transit Railway

Corporation and the Kowloon-Canton Railway Corporation only

so far as is practicable and compatible with the discharge

of any function or the exercise of any power or duty

conferred or imposed upon them according to law.

39. (1) Subject to this section, this Ordinance

shall bind the Crown.

(2) Section 5, 6, 7, 12, 13, 14, 15 or 16 shall not

have effect to permit proceedings to be taken against, or

to impose any criminal liability on, the Crown or on any

public officer who causes or permits to be made any noise

in the course of carrying out his duties in the service of

the Crown.
