or such further period as the

Secretary may allow; and

(b)

unless he is satisfied that

the Corporation has taken all

reasonable steps to otherwise

acquire the land including

negotiating for the purchase

thereof on terms that are

fair and reasonable.

(4) The Secretary shall not make

a recommendation in pursuance of

subsection (2)(b)

unless the development

proposal may lawfully be

implemented by virtue of the

provisions of any draft or

approved plan for the

purposes of the Town Planning

Ordinance and, in the case

where by virtue of such plan,

permission under section 16

of that Ordinance is required
