PARTITION (AMENDMENT) BILL 1987-

COMMITTEE STAGE

I move that clause 4 of the Bill be amended as set

out in the paper circulated to Members.

As it stands at present new section 3B (3)(a)(ii) in clause 4 provides that a memorandum filed by the Director of Buildings and Lands in a partition action will not operate to prevent the making of an order to prevent the lapse of a caveat against land dealings.

It has been brought to my attention that there is no system of caveats against land dealings in Hong Kong and that therefore this provision serves no practical purpose.

The amendment will delete this provision.
