proper implementation of the basic policies enshrined in

the Joint Declaration:

(a)

in doing so, to act in accordance with the advice of the

Chief Executive's Council (see Note 2) or to place on

record his reason for not accepting the Council's advice.

To accord with the provisions of the Joint Declaration, the specific powers and functions of the Chief Executive, as Head of

the SAR Government, should include:

to nominate members of the Chief Executive's Council for appointment by the Central People's Government and to chair

the Council;

to direct the work of the public service;

to nominate principal officials and advisers of equivalent

rank for appointment by the Central People's Government;

to appoint and dismiss other public servants, acting in

accordance with the advice of an independent public service

commission;

to appoint and remove judges in accordance with the procedures laid down in the Joint Declaration;

to deal with external economic, cultural and similar

affairs, as authorised by the Central People's Government;

to perform such other statutory functions as may be

provided for within Hong Kong Law.

At present the Governor enjoys certain specific powers with regard to the Legislature both in his capacity as Governor and as
