(b) whether, if the amendments envisaged in sub-

paragraph (a) are to be drafted, the FCO

should be consulted, at least if it is felt that there may be a need for an Order in Council under section 18 of the 1870 Act in respect of those amendments; and

(c) whether, in any case, an Order in Council is

belatedly required under section 18 of the

(a)

Act in respect of the reference to "every prison

etc." in section 4

of the Ordinance (Cap. 236).

My own views are that

drafting approval be sought (from SASI?) for the amendments referred to at para. 11(a) above;

(b) FCO should be informed, because of the subject

matter, by being provided with a copy of the Bill; but that there is no need to propose an Order in Council in respect of the Bill;

(c)

there is no need to seek an Order in Council to endorse the amendments made to section 4 almost 50 years ago, since none was ever needed.
