EXTRADITION (HONG KONG) AMENDMENT BILL 1986

1 I recall seeing these papers about two months ago.

I advised at the time that I agreed with the conclusions in paragraph 13 of the Memorandum prepared by the Deputy Law Draftsmen. In other words, on the main point at issue, I agree that no Order in Counsel is required.

2 I think it would be worth trying to discover my previous advice on this since you may also find out whether or not a reply has already in fact been sent.

3 I will minute separately on the reply to Graham Arnell on the Home Office White Paper. His letter is very

similar to others which the Home Office have received in connection with the White Paper and may represent the first round in a campaign of pressure from Hong Kong to retain the prima facie requirement. The Home Office are sending to me a copy of a letter which they have sent in reply to similar criticisms and I will send you a draft reply based on this in the near future.
