Transfer of Sentenced Persons

Thank you for your letter of 30 June.

In the light of your comments it has been decided that we should aim initially to extend the Repatriation of Prisoners Act to Hong Kong by Order in Council. Before seeking the Executive Council's formal approval for this proposal we would like to clarify one or two points relating to the operation of the Act.

First, when ExCo considered the desirability of Hong Kong participating in the Convention on the Transfer of Sentenced Persons the Council advised and the Governor ordered

"that HMG should be informed that the Hong Kong Government wished, in principle, to participate in both the Council of Europe Convention on the Transfer of Sentenced Persons and any similar bilateral agreement to which HMG might become a party, subject to the arrangements including a satisfactory procedure for each case involving Hong Kong to be considered on its merits by the Governor, consulting the Executive Council as necessary.

We envisage that in order for ExCo to be

consulted on transfers the procedures would have to be as set out below.
