said it was prepared to answer the questions from the EFTA countries but that any document from the EEC side should be sent out in concert. This was agreed by the Chairman. Spain wanted

it recorded in the minutes that Gibraltar presented a specific

problem at a political level and that whatever solution was agreed between the UK and Spain bilaterally should be accepted by

the EFTA and EEC countries. The UK said that this matter ought

rather to go in the minutes of the EEC Group rather than those of

the enlarged Group but this did not seem to satisfy Spain. The

Chairman thought that this matter ought to be left over for the

moment as he saw difficulties in airing bilateral problems before

Third States.

Portugal said it would like to extend to the territory of

Macao. Denmark and the UK explained that any list provided was

not for the purpose of negotiating territory by territory but

rather to give an indication of the likely territorial scope of

the Convention. This point was strongly agreed to by France.

The Chairman proposed that the contributions from each concerned

Member State would be combined in a document to be sent to the

EFTA countries.

Protocol No. 1 Article 1 (Swiss reservation)

12. The Chairman reviewed the latest Swiss document (Document

No. 37) which indicated that the Swiss have acceded to

Conventions regulating jurisdiction on contractual matters

notwithstanding Article 59 of the Swiss Constitution. After a

brief discussion is was agreed that the EEC position should be

maintained.

13. The Group considered the possibility of the ECJ attending

the Diplomatic Conference and making a unilateral declaration on
