Order

The full list of circumstances bringing people within the

set out in Annex 2 of the White Paper should be

incorporated in the Order itself.

Alternatively, it would be far simpler to define those having a connection with Hong Kong as "Hong Kong Belongers" as

defined in Hong Kong's own Immigration Ordinance.

PROVISION IN THE ORDER

Article 2 of the draft Order summarises succinctly all

the circumstances of people who will be affected by the Order. Annex 2 of the White Paper describes people's possible

circumstances in more detail.

ANNEX 2 TO THE WHITE PAPER

Article 2 as drafted is comprehensive and comparatively

straightforward. Further detail is not necessary. In any event

people may not understand all the references to legislation in

Annex 2 since they may not know under precisely what provision

of the British Nationality Acts they have acquired their British

Dependent Territories citizenship. But they will probably know

whether they were, for example, descended from a person registered

in Hong Kong or not.

Annex 2, however, is intended to help people who wanted to

go into it a bit more deeply and identify their own particular

circumstances. We hope it is all-embracing, but of course it may

not be so.
