"We believe our response to the Legislative Council has shown that we pay close attention to the views expressed by the Council and the people of Hong Kong and that, as a result, the nationality provisions for Hong Kong have been clarified and improved. We believe it would be right now to put in place the nationality provisions which have been extensively discussed in Parliament and in Hong Kong so that detailed planning work can continue without delay. I intend therefore to lay the draft

Order in Council before the House in the next few days.'

The Hong Kong Act 1985 provided for the ending of British sovereignty and jurisdiction over Hong Kong on 1 July 1997, in

the accordance with the terms of the Joint Declaration on question of Hong Kong of HMG and the Government of the People's Republic of China. Under the terms of the Joint Declaration Hong Kong will become a Special Administrative Region (SAR) of the People's Republic of China on 1 July 1997. An exchange of memoranda associated with the Joint Declaration deals with the status of persons after 30 June 1997 who at present are BDTCs, and related issues. Paragraph 2 of the schedule to the Hong Kong Act conferred power to give effect by Order in Council to the nationality provisions of the United Kingdom Memorandum.
