Lord Chitnis is correct in saying that it is a convention

that Orders in Council are not voted on in the House of

Lords. The procedures for dealing with affirmative

Orders in Councils are that the instrument is laid before

both Houses at the same time. The instrument is

considered by the Joint Committee on Statutory

Instruments and will, after consideration, draw attention

to Parliament matters of controversy. A motion and

debate may follow. If the motion in the Commons is

successful the Lords consider the instrument but although

they may debate it, at some length, do not vote. In

cases of serious disagreemnt they may "pray" or express

their disatisfaction against the Order; it does not

affect the confirmation of the Order.
