VISA ABOLITION AGREEMENTS

1. We spoke briefly this morning about Richard Fries' letter of 16 January about the extension of Visa Abolition Agreements to cover BN(0)s. The letter refers particularly to the Visa Abolition Agreement with the Netherlands, but is to be read in the wider context.

2. I said that I thought this letter is written on a basic misconception. When the British Nationality Act 1981 was brought into effect, no steps were taken to amend individual agreements. A Note was sent to all foreign governments explaining that inter alia the three national statuses of British citizen, British Dependent Territories citizen and British Overseas citizen were to replace Citizenship of the United Kingdom and Colonies. Therefore, in all our international agreements, the expression 'Citizen of the United Kingdom and Colonies' should be read as applying to those new statuses. A copy of this note of 11 October 1982 is attached. It is my understanding that we envisage a similar procedure in regard to BN(0)s, with the action being taken during the period following the passage of the Hong Kong Nationality Order and before its coming into operation.
