MEMORANDUM FOR EXECUTIVE COUNCIL

The Objectionable Publications Ordinance

(Chapter 150)

CONTROL OF OBSCENE, VIOLENT AND INDECENT ARTICLES BILL 1986

Introduction

The purpose of this memorandum is to seek Members' approval for the introduction of the Control of Obscene, Violent and Indecent Articles Bill, at Annexe A, into the Legislative Council; or for its publication for public prior to its introduction into the

information and comment Legislative Council.

The Bill seeks

to repeal the Objectionable Publications Ordinance (Chapter 150);

to enact, in its place, a Control of Obscene, Violent and Indecent Articles Ordinance which will provide comprehensive legislative means to control obscene, violent, repulsive and indecent articles; and

to establish a judicial body for determining or classifying expeditiously articles as obscene, indecent or neither indecent.

On 22 April 1986, after considering memorandum XCC (86) 74 (copy at Annex B), the Council advised and the

Governor ordered

the proposals as described in paragraphs 7 to 34 of the memorandum should be approved in principle but that

(i) there should be two interim hearings;
