I recommend that the Secretary of State replies on the

lines of the first attached draft (draft A), which takes into

account the Governor's strong hope that the Secretary of State should not correspond with Mr Jackson-Ligkin on the substance of his letter. I attach a second draft which could be sent if

draft which the Secretary of State felt that this advice was not

acceptable: its text has been cleared with the Hong Kong

Government.

Mr Jackson-Lipkin, a Judge of the

High Court of

Hong Kong, wrote to the Secretary of State in a letter dated

13 December to report

overseas recruiting for

Agency and a number of Hong Kong judges. In his address to the judges, Mr Xu stressed the Chinese wish that foreign nationals

should continue to work in Hong Kong for the stability and

prosperity of the territory, and that China would both allow

and encourage them to do so after 1997. The Secretary of State

has commented that he is not clear about the nature of the

Chinese concern "about the ban on

the Civil Service". This letter
