Explanatory Memorandum

This Bill makes miscellaneous amendments to the Drug Addicts Treatment and Rehabilitation Ordinance in the light of a review of the Ordinance, which was enacted in 1960.

The amendment in clause 2 reduces the maximum age of a young person, as defined in section 2 of the principal Ordinance, from 19 years to 18 years. The result will be that only persons who are under 18 years of age will, by virtue of section 7, require the consent of a parent or guardian for treatment at an Addiction Treatment Centre. The same age limit is prescribed for the purposes of the Protection of Women and Juveniles Ordinance.

3. The amendments in clause 3 will make it unnecessary to publish in the Gazette the appointment of Addiction Treatment Centre Visitors, and will require such visitors to visit a centre once at least in every 3 months, instead of once at least in every month as at present.

4. The amendment in clause 4 replaces the Secretary for Security for the Secretary for Home Affairs on the Addiction Treatment Centre Appeal Board, since the post of the Secretary for Home Affairs has been abolished.

5. The amendments in clauses 5, 6, 7, 8 and 9 increase the various monetary penalties for offences under the Ordinance and the regulations made thereunder. The

penalties were first prescribed in 1960 and are being updated.

6. The Bill has no Public Service staffing or financial implications.

一九八六年戒毒人治療與康復(修訂)條例草案

摘要說明

本條例草案根據當局對戒毒治療與康復條例檢討結果,而對該條 例作出若干雜項修訂。該條例在一九六○年制定。

草案第二條所作的修訂條款,把原有條例第二條所界定的「年靑人」 年齡降低,由十九歲降為十八歲。由於這項修訂,只有年齡未滿十八歲的年青 人,才須按照該條例第七條規定,先行徵得家長或監護人同意,而在戒毒所接 受治療。保護婦孺條例亦已制訂相同的年齡限制。

三、 草案第三部所作的修訂規定如下:有關戒毒所視察賓客的委任令, 今後不須在憲報公布。另外,戒毒所視察賓客今後袛須每三個月視察戒毒所最 少一次,而不須像目前每月最少視察一次。

四、 草案第四條所做的修訂規定如下:由於「民政司」這一職位現經取 消,戒毒所上訴委員會內由前民政司擔任的職責,現由保安司接掌。

五、 草案第五、第六、第七、第八和第九條所作的修訂規定如下:凡觸 犯原有條例和依該條例而制定的規例內列罪名,罰款額現予調高。原有罰款額 最初在一九六○年訂定。當局目前正進行修改這些罰款額,以便切合現況。

六、 本條例草案對政府開支和人手需求方面都沒有影響。
