(a) the Public Health and Municipal Services (Amendment) (No. 2) Bill 1986 (Annex A) should be introduced into the Legislative Council; and

(b) the Smokeless Tobacco Products (Prohibition) Regulations 1986, as set out at Annex B, should be approved in principle, to be referred back to Members to be made after the Bill has passed into law.

At the meeting of the Executive Council on 22 July 1986, having considered memorandum XCC(86)129 at Annex C, the Council advised and the Governor ordered that the importation, sale and manufacture of smokeless tobacco products should be banned and that the Government's intention to legislation to effect the proposed ban should be immediately.

The Attorney General's Chambers have advised that it would be appropriate for the ban to be effected by way of regulations made under the Public Health and Municipal Services Ordinance (Chapter 132). The definition of food in the existing Ordinance is modified by Clause 2 to include smokeless tobacco products, i.e. tobacco products which are taken orally, but to exclude tobacco subject to combustion and dry snuff taken by inhalation. Clause 3 widens the existing power to make regulations prohibiting or regulating the importation of any food or drugs which may be prejudicial to the public health
