Explanatory Memorandum

This Bill amends the Drug Addiction Treatment Centres Ordinance.

Clause 2 amends section 4 of the Ordinance to reduce the minimum period of detention in a Drug Addiction Treatment Centre ("DATC") from 4 months to 2 months.

3. Clause 3 amends section 6 so that a person released from a DATC under a supervision order and who is later recalled to the DATC shall, on his release from that period of recall, continue to have the benefit of any unexpired portion of that supervision order.

4. Under section 6A if a person the subject of a detention order, supervision order or recall order is sentenced to imprisonment for more than 2 years that order lapses. Clause 4 amends this section to reduce the period of 2 years to 9 months.

5. To avoid multiple supervision by the Commissioner of Correctional Services and other person (e.g. Director of Social Welfare) clause 5 adds section 6B to provide that an existing supervision order shall lapse if the supervised person is put under the supervision of a person other than the Commissioner.

6. Clause 6 amends section 109AA(2) of the Criminal Procedure Ordinance consequent upon the amendment in clause 4.

7. The Bill provides that the amendments made by it will not affect supervision orders made before its commencement.

8. There are no Public Service staffing or financial implications.

本條例草案修訂戒毒所條例。

二、 草案第二條修訂原有條例第四條;新規定縮減戒毒者得受戒毒所羈 留的最短期限,由原訂四個月減為兩個月。

三、 草案第三條對原有條例第六條修訂,從而規定:按照監管令所訂 條件獲戒毒所開釋者,如受召回戒毒所再受羈留,則他在該段召回期終結而獲 釋後,得繼續接受該監管今的惠澤,但以該命令所餘有效期為限。

戒毒所條例第六條原規定:羈留令、監管或召回令所針對的人 如受判處監禁為期超過兩年,該命令即告無效。本草案第四條修訂該第六A條

,從而把原訂刑期縮減,即由原訂兩年減為九個月。

五、 為避免懲教署署長和另一位人士(例如社會福利署署長)的多重監管 起見,本草案第五條在原有條例內加第六條,從而規定:受監管者如交 由懲教署署長以外的一位人士子以監管,則原有監管令即告失效。

六、本草案第六條因應第四條所作出的修訂,而把刑事訴訟程序條例第 一○九AA條第(2)款修改。

七、本條例草案規定:凡在本條例草案開始生效之前已發出的監管令, 均不受本條例草案所作出的修訂規定影響。
