UK DENUNCIATION OF IL CONVENTIONS:

TERRITORIES

EFFECT ON NON-METROPOLITAN

I refer to my minute of 24 March on the above subject and should be grateful for an early reply, particularly on Convention 26, which the Department of Employment (DE) tell us is particularly urgent.

2.

DE point out that it is important to establish the position when the conventions were originally applied to the territories in question; and to ascertain if they were in fact self-governing at that time. For example, in the replies received from Anguilla and Falklands, copies attached, they refer to 'UK power of disallowance'. Could you check with your legal adviser on how we should interpret this with regard to section 35 of the ILO constitution.
