Amend the Labour Tribunal Ordinance.

Enacted by the Governor of Hong Kong, with the advice and consent of the Legislative Council thereof.

1. This Ordinance may be cited as the Labour Tribunal (Amendment) Ordi- Short title. nance 1986.

Section 39 of the principal Ordinance is amended—

(a) in subsection (1) by deleting "at such rate as may be prescribed" and

substituting the following-

"at the rate specified in subsection (4)”;

(b) in subsection (3) by deleting "at such rate as may be ordered by the tribunal”

and substituting the following-

"at the rate specified in subsection (4)"; and

(c) by inserting after subsection (3) the following—

(Cap. 336.)

"(4) The rate of interest specified for the purposes of subsections (1) and (3) shall be the rate fixed by the Chief Justice by notice in the Gazette under section 50 of the District Court Ordinance.".

Rule 13 of the Labour Tribunal (General) Rules is revoked.

Explanatory Memorandum

This Bill amends section 39 of the Labour Tribunal Ordinance to provide that the rate of interest in respect of claims and awards in the Labour Tribunal will follow the rate prescribed by the Chief Justice in respect of judgment debts in the District Court.
