Law Officer (Special Duties) does not consider that we will be giving anything away for future boundary discussions by releasing the chart. He is however slightly concerned that the chart could provoke a negative response from the Chinese in that it shows British military aircraft may fly over waters outside the "Box". These may be regarded by the Chinese as their waters.

Our view is that objection is unlikely since:

flying boundaries traditionally bear no necessary relation to territorial boundaries;

FIR's are based on international civil aviation agreements; and

military aircraft have flown up to the Military Outer Flying Boundary for many years.

I would be grateful if you could let me know whether you support our proposal to declassify the chart. A reply by telegram would be greatly appreciated.
