Introduction
A
The purpose
of this memorandum is to seek authorisation for road works, and the use as described in Annex A, to enable the construction of the Eastern Harbour Crossing and associated road works to proceed.
Background

At the meeting on 12 September 1984, after considering memorandum XCC (84) 106,
XCC(84)106, Members advised, and the Governor ordered, that the private sector be invited to submit proposals to finance, construct and operate a new road (or road and rail) tunnel across the harbour between Quarry Bay on Hong Kong Island and Cha Kwo Ling on Kowloon.

As a result, GN2912 published in the Government Gazette on 5 October
1984, invited parties interested in obtaining the franchise for the Eastern Harbour Crossing to submit proposals for financing, constructing and operating the Eastern Harbour Crossing. Government, after examination of the nine submissions, reported to members in memorandum XCC (85) 87, who advised that a rail tunnel be incorporated as part of the Project. Detailed negotiations then commenced with the three shortlisted Consortia.

The results of the detailed financial, engineering and operational assessments were considered by Council in memorandum XCS (85)7 dated 3 December 1985. Council advised, that as a result of such assessments the proposal submitted by the New Hong Kong Tunnel Consortium* should form the basis of a 'contract' between Government and the Consortium. The performance of this would be conditional only on the enactment of the Eastern Harbour Crossing Ordinance.
