4. OWNERSHIP
4.1. UNDER EXISTING LEGISLATION, THE PRINCIPAL LINK BETWEEN SHIPS ON THE REGISTER AND THE STATE OF PEGISTRATION DERIVES FROM OWNERSHIP REQUIREMENTS, I.É. AN INDIVIDUAL OWNER SHOULD BE A
BRITISH NATIONAL AND A CORPORATE OWNER SHOULD BE ESTABLISHED
UNDER AND SUBJECT TO THE LAWS OF THE UNITED KINGDOM OR A DEPENDENCY OF THE UNITED KINGDOM AND HAVE ITS PRINCIPAL PLACE OF BUSINESS IN THE UNITED KINGDOM OR A DEPENDENCY OF THE UNITED KINGDOM. THE MAIN OBJECTIVE OF THESE REQUIREMENTS IS TO ENSURE A CLOSE LINK AND PESPONSIBILITY BETWEEN THE STATE OF PEGISTRATION
AND THE SHIP FOR THE PURPOSE OF ENFORCING SAFETY AND OTHEP
STANDARDS.

CLEARLY THE CONCEPT OF A CORPORATE OWNER HAVING ITS
PRINCIPAL PLACE OF BUSINESS LOCATED IN THE UNITED KINGDOM OR ITS
DEPENDENCIES IS INAPPROPRIATE FOR THE MODIFIED REGISTER FOR
HONG KONG. TO CONTINUE TO MEET THE OBJECTIVES OF THE PRESENT REQUIREMENTS IN THE CONTEXT OF A REGISTER IN HONG KONG AND TO ENSURE A SMOOTH TRANSITION IN 1997, IT IS PROPOSED THAT THE PIGHT TO PEGISTER A SHIP ON THE MODIFIED HONG KONG REGISTER SHOULD BE LIMITED, IN THE CASE OF COPPORATE-OWNED SHIPS, TO COMPANIES INCORPORATED IN HONG KONG. IT WILL NOT BE NECESSARY FOR THE
COMPANY TO HAVE ITS PRINCIPAL PLACE OF PUSINESS IN HONG KONG. IN THE CASE OF INDIVIDUAL OWNERS, ARRANGEMENTS WILL NEED TO BE MADE TO LIMIT THEIR ENTITLEMENT TO REGISTER SHIPS TO THE
PEGISTRATION BY PERSONS OPDIMARILY RESIDENT IN HONG KONG.
4.3. THUS, IT IS PROPOSED THAT IN ORDER TO DE ENTITLED TO REGISTER A SHIP ON THE MODIFIED HONG KONG REGISTER, THE OWNER
