Explanatory Memorandum

This Bill provides for the construction and operation by the Kowloon- Canton Railway Corporation of a light rail system serving Tuen Mun New Town and Yuen Long and also for the setting up of a North-west Transit Service Area in the vicinity of this railway in which the Corporation will operate a public bus system.

Amendments of substance to the Kowloon-Canton Railway Corporation Ordinance include the following--

(a) clause 5 confers on the Corporation the powers to construct and operate the new light rail system and to operate bus services within the North-west Transit Service Area;

(b) clause 6 as read with clause 20 vest in the Corporation rights in relation to

land needed for the new railway;

(c) clause 8 increases the borrowing limits of the Corporation from $1,500,000,000 to $3,000,000,000. The provision that the Financial Secre- tary may authorize an increase of this sum is not affected;

(d) clauses 10 and 12 extend provisions of Part V relating to the extension of the

Kowloon-Canton Railway to the construction of the new railway;

(e) clause 13 relieves the Corporation from the obligation it would otherwise

have to reimburse the Government for land acquired for the new railway;

(f) clause 14 enables the Governor in Council to make regulations dealing with signs and indicators on the Corporation's buses and to provide pro- grammes, similar to those provided by bus operators under the Public Bus Services Ordinance (Chapter 230), relating to the Corporation's transport services in the North-west Transit Service Area;

(g) clause 15 extends the Corporation's by-law making powers to the new railway and, with the exception of the restricted area provisions, to its bus services;

(h) clause 16 enables the Corporation to control the laying of cables and pipes within the wayleave area of the new railway and extends certain provisions of the Tramway Ordinance (Chapter 107) to that railway;

(i) clause 17 extends the existing power of the Building Authority to exempt construction work on the Kowloon-Canton Railway from the Buildings Ordinance (Chapter 123) to construction work on the new railway, exempts this work from the requirements of section 13 of the Summary Offences Ordinance (Chapter 228) and also frees from control under the Public Health and Municipal Services Ordinance (Chapter 132) advertisements erected under the authority of paragraph 3(c) of the new Fifth Schedule inserted by clause 20 of the Bill;

(j) clause 18 states that, with some exceptions, the Public Bus Services Ordinance (Chapter 230) does not apply to the Corporation's bus services in the North-west Transit Service Area;

Clause 22 amends the Public Bus Services Ordinance (Chapter 230) to enable existing franchises of bus operators in the North-west Transit Service Area to be amended and consequential amendments made to designated routes. Compen- sation is payable if this is done without the consent of the franchise holder.

4. Clause 23 amends the Public Bus Services Regulations to prohibit the improper picking up and setting down of passengers in the North-west Transit Service Area. If they are improperly picked up or set down, the grantee commits an offence. Bus stops in the area may be restricted to certain categories of passengers.

5. Clause 25 exempts the Corporation's buses for use within the North-west Transit Service Area from paying registration tax.

6. Clause 26 modifies the Road Traffic Ordinance (Chapter 374) to deal with the vehicles of the new railway-these will be treated much as are trams at present.

7. There are no significant Public Service staffing implications. Compensation may be payable to franchised bus operators under clause 22 in an amount which cannot at this stage be quantified.

本條例草案就九廣鐵路公司建造和經營來往屯門新市鎮及元朗兩地 的輕便鐵路系統一事,作出規定;此外,本草案亦規定在這條鐵路附近須設立 —「新界西北部輕便鐵路服務區」,而該服務區內的公共巴士系統,須由九廣鐵 路公司兼營。

(a)

本條例草案對九廣鐵路公司條例所作的實質修訂包括下述各項在

草案第五條授權九廣鐵路公司建築和經營新的輕便鐵路系統,並且 在新界西北部輕便鐵路服務區內經營各項巴士服務;

(b) 草案第六條配合草案第二十條,就建築新鐵路需用的土地,賦予九

廣鐵路公司若干權利;

(c) 草案第八條調高該公司的借款限額,由原先的15億元增為30億元。

有關財政司可以批准增加借款數目這項規定,則並不受影響;

(d) 草案第十和第十二條規定把原有條例第五部內載有關九廣鐵路擴建

事宜的條文適用範圍擴大,以便那些條文亦適用於建造新鐵路;

九廣鐵路公司原須向政府償還後者為上述新鐵路收購用地而作出的 開支,但草案第十三條規定免除該公司該項償還債務責任;

(f) 草案第十四條授權總督會同行政局就九廣鐵路公司巴士的適當標誌 和(目的地)指示標誌而制定規例;此外,本條文亦規定九廣鐵路公 司須就該公司在新界西北部輕便鐵路服務區內提供交通服務事宜, 呈交類似其他巴士經營商按公共巴士服務條例(香港法例第二三〇 章)規定而制訂的服務計劃;

(g) 草案第十五條擴大九廣鐵路公司制定附例的權力,從而使該公司亦 可針對新鐵路和其巴士服務事宜而制定附例,但是,就該公司的巴 士服務而言,任何與禁區規定有關的事宜都視為例外:

草案第十六條授權九廣鐵路公司對於在新鐵路道路通行權區域內敷 設電纜和管道事宜,加以管制;此外,本條文並把電車條例(香港 法例第一○七章)的若干項條文的適用範圍擴大,以便那些條文亦 對輕便鐵路適用;

草案第十七條擴大建築事務監督的現行權力,以便該監督除可豁免 九廣鐵路建築工程行建築物條例(香港法例第一二三章)的規定外

,亦可豁免新鐵路建築工程受該條例限制;本條文並且規定新鐵路 建築工程豁免遵行簡易程序治罪條例(香港法例第二二八章)第十三 條的規定,此外並規定:凡根據本條例草案第二十條所增訂新第五 附表第3(c)段所賦權力而豎立的廣告,都不受公共衞生及民康市政 條例(香港法例第一三二章)所管制;

(j) 草案第十八條述明,除若干例外情況外,公共巴士服務條例(香港 法例第二三〇章)對於九廣鐵路公司在新界西北部輕便鐵路服務區 內的巴士服務並不適用;
