Objection under
Roads (Works, Use and Compensation) Ordinance Cap 370 - Ground Floor shop and front portion in
1st Floor of No. 56 Percival Street
I refer to your letter dated 15 January 1986 to the
Highways Office, Engineering Development Department.
As the captioned footbridge construction will not affect the property right of the private lot on which your property is situated, in my opinion, it is unlikely that compensacion will ** be payable under the provisions of the Roads (Works, Use and Compensation) Ordinance Cap 370.
However, you are at liberty to employ a Chartered Surveyor (General Practice) at your own cost to assess the loss which, in your opinion, is due to the footbridge construction. If your clain for compensation can be substantiated under the provisions of the said Ordinance, you will be reimbursed for the professional fees reasonably incurred in the preparation of the claim provided such fees are acceptable to Government. On the other hand, if your clain cannot be justified, I am afraid I cannot recommend Government to reimburse the fees to you.
A Chinese translation is enclosed herewith for your ease of reference.
