under section 11(3) of the Roads (Works, Use and Compensation) Ordinance (Chapter 370) Governor in Council should exercise discretion or decline to exercise discretion to refer the plan, scheme objections to the Town Planning Board as mentioned in paragraph 20 above;

under section 11(2)(b) of the Roads (Works, Use and Compensation) Ordinance (Chapter 370) the Governor in Council should authorize the works and the use as described in Annex A or decline to authorize the works and the use.
