in the last 12 months of that five year period he or she was not outside the United Kingdom for more than 90 days; and

in the last 12 months of that five year period his or her stay in the United Kingdom was not subject to any time limit under the immigration laws; and

he or she was not at any time in that five year period in the United Kingdom in breach of the immigration laws.

Special Circumstances

All applicants (except those covered by paragraph 5 below) must be free from any restriction under the immigration laws on the date of application and meet the requirement described in paragraph 3(i). But the Home Secretary may make an exception to the other requirements if he thinks that there are special circumstances. If you do not meet those requirements but you believe there are special circumstances in your case, you should write to the Home Office, Nationality Division, to check whether it is worth making an application. You must explain what the special circumstances are.

Crown or Similar Service

An alternative to the five years residence requirement is that an applicant is or has been in Crown service under the government of a dependent territory or is or has been in service as a member of a body established by law in a dependent territory, the members of which are appointed by or on behalf of the Crown. Registration will be exceptional. An applicant will be required to show that he or she:

is or has been the holder of a responsible post; and

is or has been giving outstanding service; and

iii

has some close connection with the United Kingdom; and explain the special circumstances he or she feels the Home Secretary should take into account when considering the application. Anyone who thinks he or she might qualify for registration on grounds of such service should write, in the first instance, to the Governor of the dependency concerned.

How to Apply

6 An application for registration on the grounds of United Kingdom residence or Crown or similar service should be made on form B. A guide on how to apply is supplied with each form which can be obtained by writing to or telephoning, the Home Office (Nationality Division).
