MEMORANDUM FOR EXECUTIVE COUNCIL

Legislative Council (Electoral Provisions) Ordinance (No. 13 of 1985)

LEGISLATIVE COUNCIL (ELECTORAL PROVISIONS) (REGISTRATION OF ELECTORS AND

APPOINTMENT OF AUTHORIZED REPRESENTATIVES) (AMENDMENT) REGULATIONS 1986

Introduction

The purpose of this memorandum is to seek Members advice

as to whether under section 19 of the Legislative Council (Electoral Provisions) Ordinance 1985 (No.

(No. 13 of 1985), the Legislative Council (Electoral Provisions) (Registration of Electors and Appointment of Authorized Representatives) (Amendment) Regulations 1986, as set out at Annex A, should be made.

Members will recall that

3 December 1985, after considering memorandum XCC(85)157 (Annex B) and the Bill annexed thereto, the Council advised and the Governor ordered that the matter should be reconsidered by the Council in one week following examination by the Attorney General of quicker and simpler options for achieving the objectives of the proposal. On 10 December 1985 the Attorney General advised Members that the purposes of the proposed Bill

Objectives of the Proposal

The proposal seeks to enable members of the Regional Council, which comes into existence on 1 April 1986, to register as electors in the Regional Council electoral college constituency of the Legislative Council and to take part in an early election to be held to fill the vacancy in the Legislative Council caused by the abolition of the Provisional Regional Council on 1 April 1986. If legislation is not enacted the vacancy would not be filled until about September 1986 i.e. after 7 August 1986, the publication date of the normal register of electors.
