A specific exemption to the new limits is sought for columbaria to be erected at the proposed Chinese Cemetery in Lei Yue Mun for which plans had been approved in principle prior to finalisation of the revised height limits. Although ground level at the location is already higher than the proposed limits, the extent of relaxation needed to permit construction of the columbaria has been assessed by the Civil Aviation Department from an aviation safety point of view and found to be acceptable. This specific exemption is included in paragraph 5 of the draft amending Order.

Existing structures (as distinct from buildings) which exceed the present height limits, and which are listed in the Second Schedule, will continue to be exempted. Consideration is being given to introduction of a simpler method of permitting future exemptions in respect of such facilities as masts, aerials, radar and other equipment erected with the approval of the Director of Civil Aviation. Members' advice will be sought in due course.
Development implications

The immediate implications of implementing the revised limits in the Phase 1 area are slight, given that existing buildings are exempt. The new limits are more stringent for parts of Sai Wan Ho, Shau Kei Wan and Cha Kwo Ling. When new development or redevelopment takes place, the capacity will obviously be reduced. However, in some other areas including Chai Wan, Siu Sai Wan and Lei Yue Mun the revised limits represent a relaxation and greater development would be possible. Overall there is a modest net gain in development potential.
Timing

It is proposed that this Order takes effect from 1 December 1986. The present intention is to deal with the remainder of the Territory in a second, final phase around the end of 1987 or shortly thereafter.
